General Conditions of Contract

GENERAL CONDITIONS OF ON-LINE CONTRACTING

Through this website, CLUB NÀUTIC L’ESCALA offers an online booking service for port services and nautical activities, which will be governed by the conditions set out below.

1.- Scope of application of the General Conditions of Online Contract:

They apply ONLY to reservations made online via the Web.

They apply to reservations for the following services:

  • Port services for vessels in transit and with stays of less than one month.
  • Nautical activities.

Reservations for port services for mooring annual passes, seasonal or greater than one month, which have their own reservation and cancellation policy and for which they must go directly to the Port offices are expressly excluded from these general conditions.

These General Conditions are configured as complementary provisions to those already provided for in the Club’s regulations and regulations, so that any doubt or contradiction that may arise between these General Conditions and the rest of the Club’s regulations and regulations will be resolved by the Club Management, giving priority to the regulatory provisions in any that may be contradictory.

 

2.- Port services for vessels in transit and with stays of less than one month.

Booking and payment:

To confirm the reservation of a mooring on the website, the user must make an advance payment, at the time of booking or upon receiving confirmation of availability. The rest of the payment, if applicable, must be made before the start of the contracted service, in accordance with the corresponding deadlines.

The data provided by the user and/or boat must be valid. Before the start of the service, accreditation may be requested by the user of the data provided. In case these do not coincide or the user does not identify himself/herself, access to the service may be denied.

In the case of providing bank details, these will be entered into the computerized files of the Club Nàutic l’Escala to proceed with the collection of the fee and established services. The invoices issued by the Club Nàutic l’Escala will be charged to the current account number that you have indicated and according to the maturities that appear on the same invoices and in accordance with the conditions provided in your contract or request for the provision of services. Any modification in the data must be notified to the Club Nàutic l’Escala. In the event that the receipt is returned by the user contracting the service, he must assume the bank charges generated.

Change and cancellation policy:

As a general rule, in case of canceling the reservation of the mooring of boats in transit or with stays of less than one month, 50% of the advance payment will be paid, as long as the cancellation occurs more than 48 hours before the start of the contracted service.

In the case of requesting a change in the reservation, this must be requested up to 48 hours before the start and may or may not be applied, depending on availability.

In the event that the reservation is canceled or you want to modify it within the last 48 hours prior to the start of the service, the advance payment will not be paid in any case or in any proportion.

 

3.- Nautical activities

Booking and payment:

To confirm the reservation of any nautical activity on the website, the user must make an advance payment, at the time of booking or upon receiving confirmation of availability. The rest of the payment, if applicable, must be made before the start of the contracted service, in accordance with the corresponding deadlines.

For nautical activities, it will be necessary to make the rest of the payment up to 7 days before the start of the activity. In case of not receiving the payment within this period, the reservation of the activity will be canceled without the right to claim by the user of the payment on account made.

The data provided by the user must be valid. Before the start of the activity, accreditation may be requested by the user of the data provided. In case these do not coincide or the user does not identify himself/herself, access to the service may be denied.

In case of canceling the reservation, 50% of the advance payment will be paid, as long as the cancellation occurs more than 15 days before the start of the contracted service.

In the case of requesting a change in the activity, this must be requested up to 15 days before the start and may or may not be applied, depending on availability.

If the reservation is canceled or you want to modify it within 15 days prior to the start of the activity, the advance payment will not be paid in any case or proportion.

 

4.- Responsibility:

The user must take care of the facilities and the material provided to enjoy the contracted service, being responsible for the consequences derived from their negligent action, whether this causes material or personal damage.

The user accepts and undertakes to comply with the rules and schedules established by the Port Management, in accordance with the regulations of police and operation and the internal regime of the Club. Check them out here.

CLUB NÀUTIC L’ESCALA is not responsible under any circumstances for any accident that any person may suffer within the framework of the contracted service. However, CLUB NÀUTIC L’ESCALA has taken out Civil Liability insurance, in accordance with current legislation.

 

5.- Data protection

In compliance with the new EU Regulation 2016/679 of April 27, we inform you that your personal data are included in files owned by CLUB NÀUTIC L’ESCALA, whose purpose is the management of customers as well as the management of the payment of fees, as well as the management of any activity or service related to the Club.

CLUB NÀUTIC L’ESCALA may keep the User informed of all the services and activities carried out that may be of interest to them by letter or any electronic means that you have provided us.

The data will not be communicated to third parties except when required by a competent authority. However, the website may use third-party cookies in accordance with the Cookies Policy and the user’s consent.

By contracting any of the services of the Website, the User freely assigns any right corresponding to his image obtained in photographs taken by the Organization during the course of the event, authorizing its publication in leaflets, magazines, social networks or website of the CLUB NÀUTIC L’ESCALA.

The User has the possibility to exercise the rights of access, rectification, cancellation, opposition, limitation of treatment and portability, provided for in the New Regulation (EU 2016/679) of April 27, by letter addressed to CLUB NÀUTIC L’ESCALA, Port la Clota, s/n, 17130 l’Escala (Girona) and that he may revoke his consent to receive commercial communications at any time by sending an email to club@nauticescala.com.

6.- Competent Jurisdiction:

These contracting conditions are governed by applicable Spanish law, and unless the law establishes otherwise in current regulations, including consumer and user regulations, any conflict will be submitted to the judges and courts of Girona.
